GENERAL INFORMATION
Welcome to Obsidian Madness. By accessing our website, using our online store, creating an account, or placing an order, you agree to be bound by these Terms and Conditions. Please read these conditions carefully before making a purchase.
These Terms and Conditions apply to all orders placed through our website and to the use of electronic services provided through the online store.
DEFINITIONS
For the purposes of these Terms and Conditions:
- Store means the online store operated under the name Obsidian Madness.
- Seller means Obsidian Madness operated by Jakub Landecki.
- Customer means any person who uses the website, places an order, or purchases products from the Store.
- Consumer means a customer who purchases products for purposes not directly related to their business or professional activity, where applicable law grants consumer protection rights.
- Product means any item offered for sale through the Store, including latex garments and accessories.
- Order means an offer made by the Customer to purchase Products through the Store.
- Contract means the sales agreement concluded between the Customer and the Seller.
- Business day means any day other than Saturday, Sunday, or a public holiday in Poland.
ELECTRONIC SERVICES
These Terms and Conditions also constitute the terms for the provision of electronic services through the online store. The electronic services provided through the website may include browsing product pages, creating and using a customer account, placing orders, using contact forms, subscribing to the newsletter, and receiving transactional email notifications.
The use of electronic services requires a device with internet access, an up-to-date web browser, an active email address, and enabled cookies where necessary for the proper functioning of the Store.
The Customer is prohibited from providing unlawful content or using the website in a way that disrupts its operation, security, or availability.
Electronic services are provided free of charge unless clearly stated otherwise. The Customer may stop using electronic services at any time by leaving the website, unsubscribing from the newsletter, or requesting deletion of the customer account where applicable.
ORDER PROCESS AND CONTRACT CONCLUSION
To place an order, the Customer selects a Product, chooses the available options, adds the Product to the cart, provides the required contact, billing, and shipping information, selects the available shipping and payment method, and confirms the order.
Before placing an order, the Customer has the opportunity to review and correct the order details, including product selection, quantity, shipping address, billing details, and payment method.
When you place an order through our website, you will receive an email confirming that we have received your order. This message is only an acknowledgment of receipt and does not constitute acceptance of your order.
A binding agreement between you and Obsidian Madness is formed only when your order has been accepted by us or dispatched, unless applicable law provides otherwise.
All Products displayed on our website are subject to availability. Although we make every effort to maintain accurate stock information, product availability may occasionally change without notice.
We reserve the right to decline or cancel any order at our discretion, including situations involving unavailable materials, payment issues, incorrect pricing, inaccurate product information, suspected fraudulent activity, or inability to fulfill the order.
PRICES, TAXES AND ADDITIONAL COSTS
Product prices are displayed on the website. The total price displayed at checkout includes the Product price and any applicable shipping costs shown before the Customer places the order.
Depending on the destination country and the selected shipping method, additional customs duties, import taxes, VAT, handling fees, or other charges may apply, unless clearly stated otherwise at checkout.
Customers are responsible for reviewing the total order amount, shipping costs, taxes, and any available delivery options before confirming the order.
PAYMENT
Payments must be completed successfully before any order can be processed or shipped. We accept the payment methods displayed during checkout.
The order will be processed only after payment has been successfully received or authorized. If payment is not completed, rejected, reversed, or flagged as suspicious, the order may not be processed or may be cancelled.
If we are unable to fulfill your order after payment has been received, a full refund will be issued using the original payment method, unless otherwise agreed or required by applicable law.
PROOF OF PURCHASE AND INVOICES
After placing an order, the Customer receives an order confirmation by email. Sales documents are issued in the form of invoices in accordance with applicable tax regulations. If the Customer requires specific invoice details, including company details or a tax identification number, the Customer should provide the necessary information during checkout or contact us as soon as possible after placing the order.
DELIVERY
Estimated delivery times provided on our website are intended as guidelines only. While we make every effort to dispatch orders promptly, shipping times may vary depending on destination, customs procedures, carrier performance, public holidays, and other circumstances beyond our control.
Tracking information will be provided once your order has been shipped, where available.
Available shipping methods, delivery areas, estimated delivery times, and shipping costs are displayed during checkout or described in our Shipping Policy.
CUSTOMS DUTIES & IMPORT TAXES
Customers are responsible for any customs duties, import taxes, VAT, fees, or other charges imposed by their local authorities, unless clearly stated otherwise at checkout.
Obsidian Madness is not responsible for delays caused by customs clearance procedures or unpaid customs charges.
PRODUCT REPRESENTATION
Every effort has been made to accurately display our Products. However, due to differences in screen settings, lighting conditions, photography, and the natural characteristics of latex, slight variations in colour, finish, shine, texture, or appearance may occur between product images and the final item received.
Such minor differences do not affect the Customer’s statutory rights regarding defective, damaged, incorrectly supplied, or non-conforming goods.
LATEX GARMENTS AND PRODUCT CARE
Latex garments are delicate products that require proper handling, care, cleaning, and storage. Customers should carefully read all product descriptions, size information, and care instructions before placing an order.
Damage caused by improper use, incorrect storage, unsuitable care products, excessive force, sharp objects, heat, oils, or improper handling may not be treated as a manufacturing defect.
PRICING ACCURACY
In the event that a pricing error, product description error, or technical error is identified, we reserve the right to correct the information and contact you before processing the order.
If we are unable to reach you or if you do not wish to proceed with the corrected information, the order may be cancelled and any payment received will be refunded.
ORDER CANCELLATIONS
Orders may be cancelled by the Customer at any time before the order has been dispatched or before production begins for made-to-order, customized, or individually specified Products.
Once an order has been dispatched, or once production has started for made-to-order, customized, or individually specified Products, cancellation may no longer be possible, except where required by applicable law.
RIGHT OF WITHDRAWAL, RETURNS, EXCHANGES AND REFUNDS
Consumers may have the right to withdraw from a distance contract within 14 days of receiving the goods, unless an exception under applicable law applies.
If an item arrives damaged, defective, incorrectly supplied, or significantly different from its description, please contact us as soon as possible.
After reviewing the issue, we may offer a replacement, repair, exchange, price reduction, store credit, or refund where appropriate and in accordance with applicable law.
Due to the handmade nature of our garments and hygiene considerations, returns and exchanges may be limited for items that have been opened, tried on, worn, used, damaged, washed, altered, or handled in a way that affects hygiene, safety, or the condition of the Product.
Products made to order, customized, or produced according to the Customer’s individual specifications may not be eligible for cancellation, return, or exchange, except where required by applicable law.
Nothing in these Terms and Conditions limits the Customer’s statutory rights, including rights related to defective, damaged, incorrectly supplied, or non-conforming goods.

COMPLAINT PROCEDURE
Complaints may be submitted by email to support@obsimadlatex.com.
The complaint should include the order number, Customer name, contact details, a description of the issue, and photos or other evidence where possible.
We will review and respond to complaints within 14 days of receiving them, unless applicable law provides otherwise. If additional information is required, we may contact the Customer to request further details.
If the complaint is justified, we may offer repair, replacement, exchange, price reduction, store credit, refund, or another solution required by applicable law.
LANGUAGE OF THE CONTRACT
The Contract is concluded in the language version of the website used by the Customer when placing the order, unless otherwise required by applicable law.
In case of differences between language versions, the English version shall apply to the fullest extent permitted by applicable law, without limiting any mandatory consumer protection rights that may apply in the Customer’s country of residence.
DISPUTE RESOLUTION
If you have any issue with an order, Product, payment, delivery, return, or complaint, please contact us first at support@obsimadlatex.com so that we can try to resolve the matter amicably.
These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Poland, without limiting any mandatory consumer protection rights that may apply in the Customer’s country of residence.
Any disputes arising from the use of this website or the purchase of Products shall be submitted to the competent courts in accordance with applicable law.
LIMITATION OF LIABILITY
Obsidian Madness shall not be held responsible for indirect, incidental, or consequential losses arising from the use of our Products or services, to the fullest extent permitted by applicable law.
Our maximum liability shall not exceed the value of the order placed by the Customer, except where applicable law provides otherwise.
Nothing in these Terms and Conditions limits or excludes liability where such limitation or exclusion is not permitted by applicable law.
CHANGES TO THESE TERMS AND CONDITIONS
We may update these Terms and Conditions from time to time, including for legal, operational, technical, or business reasons.
The version applicable to an order is the version in force at the time the order is placed.
FINAL PROVISIONS
These Terms and Conditions apply from the date they are published on the website and remain in force until amended or replaced.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in force.
